RECREATIONAL ACTIVITY WAIVER AND RELEASE OF LIABILITY

1. Assumption of Risk

I understand and acknowledge that participating in activities such as ATV riding, laser tag, and all other recreational events on the premises involves inherent risks, including but not limited to: - Equipment failure - Rough terrain and weather-related hazards

Collisions with objects or other riders
Animal encounters
Slip and falls
Physical strain, any injuries (including fractures, paralysis, or death)
Delayed emergency care

I freely and voluntarily assume all risks, whether known or unknown, including those caused by ordinary
negligence of the operator or staff.

2. Release of Liability

In consideration of being allowed to participate, I release and hold harmless Cloverland ATL, ATV Extreme ATL, JLS E GROUP INC, JLS Enterprises Group, its owners, agents, employees, and affiliates (the "Released Parties") from any and all claims, demands, or causes of action related to my participation, including claims of negligence.

This release does not apply to gross negligence or willful misconduct.

3. Medical Treatment & Authorization

I understand there are no medical professionals on staff. I authorize staff to provide basic first aid and to contact emergency services if needed. I agree not to hold the Released Parties liable for any assistance provided in good faith.

4. Equipment Responsibility

I agree to operate all equipment responsibly and return it in the same condition. I am financially responsible for any loss or damage caused by my misuse or negligence, up to $2,000. I authorize charges to my card after being notified of any damages after the incident.

5. Photo/Video Consent

I grant permission to use photos or video of me for marketing or promotional purposes without compensation. I may revoke this permission by providing written notice prior to participation.

6. Rules & Conduct

I agree to follow all posted and verbal rules and staff instructions. Violating safety rules, removing helmets, harassing animals, or behaving recklessly may result in expulsion without refund. Reentry after a ban is considered trespassing.

7. Jurisdiction

This agreement is governed by the laws of Georgia, with an exclusive venue in Fayette County. If any part is held unenforceable, the remainder will remain in effect. If legal action is required, the Company is entitled to recover legal fees and costs from the customer.

8. For Parents/Guardians

I affirm that I am the legal parent or guardian of any listed minors. I consent to their participation and agree to the terms of this waiver on their behalf.

9. Cancellation & Refund Policy Acknowledgment

By signing below, I acknowledge that I have read, understood, and agreed to JLS Enterprises Group, Cloverland ATL, ATV Extreme ATL, and JLS E GROUP INC Cancellation and Refund Policy. I understand that:

All reservations must be canceled at least 48 hours after booking the appointment (not 48 hours before the appointment) toreceive a full refund. You’ re able to reschedule all the way up until the day before your appointment.
Cancellations made after this time or failure to show up will result in forfeiture of any refund.
I am not entitled to a refund after the cancellation window has passed, regardless of the reason.
I agree not to initiate a credit card chargeback or payment dispute for any charges that fall within this policy.- A copy of this signed agreement may be used as evidence in response to any such dispute.

10. No-Show & Cancellation Terms

When you book a reservation with ATV EXTREME ATL, we reserve staff, equipment, and time exclusively for you. If you do not cancel your reservation at least 48 hours after booking (NOT 48 hours before your scheduled start time), or if you fail to attend for any reason, your payment will be retained in full as a cancellation fee. By completing your booking and/or signing below, you acknowledge and agree that:

This policy was disclosed to you prior to payment.
This policy applies to all reasons for non-attendance, including illness, traffic delays, personal emergencies, cancelledflights, or misunderstanding of the reservation date/time.
A “ no-show” is considered a completed sale because the service was available for your use at the scheduled date/time,and our business fulfilled its obligation to provide it.
Disputing this charge with your card issuer after acknowledging this policy may result in your signed agreement, bookingrecords, and cancellation terms being sent to the bank as evidence of a valid transaction.

11. Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, demands, actions, liabilities, costs, or expenses (including attorney’ s fees) arising out of or related to my participation, including claims brought by other participants, guests, third parties, or my own family members or estate.

12. Severability & Entire Agreement

If any portion of this Waiver is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. This document constitutes the entire agreement between myself and the Released Parties regarding my participation and supersedes any prior oral or written statements.

13. Voluntary Participation & Understanding

I affirm that I am at least 18 years of age (or the legal parent/guardian of a minor participant) and that I am voluntarily signing this Waiver. I have had the opportunity to ask questions, and I fully understand that by signing I am waiving substantial legal rights, including the right to sue for ordinary negligence.

14. Assumption of Responsibility for Guests

If I bring guests, whether or not they sign this Waiver, I assume full responsibility for their compliance with all rules, their safety, and any damages they cause. I agree to defend and indemnify the Released Parties against any claims brought by such guests.

15. Binding Effect

This Waiver shall be binding upon myself, my heirs, executors, administrators, legal representatives, successors, and assigns.

16. Communicable Disease Waiver

I understand that participating in activities at the premises may expose me to communicable diseases including, but not limited to, COVID-19. I voluntarily assume all risks associated with such exposure and release the Released Parties from any claims relating to illness, injury, or death arising therefrom.
